1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "We / Us / Our" refers to Hijau Residences, operating from 9 Jalan Tanjung Bungah, 11200 Tanjung Bungah, Penang, Malaysia.
- "Guest / You / Your" refers to any individual or organisation that submits an enquiry, enters into a rental agreement, or uses our website.
- "Property" refers to any of the residential properties managed by Hijau Residences and made available for monthly rental.
- "Rental Agreement" refers to the formal tenancy or licence agreement signed between Hijau Residences and a Guest.
- "Site" refers to our website accessible at https://hijjaurot.pro.
2. Acceptance of Terms
By using our Site, submitting an enquiry, or signing a Rental Agreement, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. These Terms and Conditions apply to all interactions with Hijau Residences, whether online or in person.
If you do not agree to these Terms, please do not submit an enquiry or proceed with a rental.
3. Property Descriptions and Availability
We make every reasonable effort to ensure that property descriptions on our Site are accurate and reflect the current condition of each property. However, properties are subject to change and availability cannot be guaranteed until a Rental Agreement is signed and the required deposit received.
Images on the Site are representative of the property. Furnishings and fittings may differ slightly from those shown where items have been replaced with equivalent alternatives.
4. Enquiries and Reservation Process
- Submit an enquiry via our contact form or by contacting us directly.
- We will confirm availability and, if suitable, invite you to view the property.
- Following a successful viewing, a Rental Agreement will be prepared for review.
- The tenancy is confirmed upon signing of the Rental Agreement and receipt of the agreed security deposit.
- A property orientation and handover will be arranged prior to your first day of occupation.
Submitting an enquiry does not create any binding obligation on either party. A binding agreement arises only upon execution of a signed Rental Agreement.
5. Rental Terms
Specific rental terms — including the rental period, monthly amount, deposit, included services, and termination provisions — are set out in the individual Rental Agreement for each property.
General conditions that apply across all properties:
- Minimum rental period: one calendar month unless otherwise agreed in writing.
- Monthly rental is payable in advance on the agreed date each month.
- A refundable security deposit (amount specified in the Rental Agreement) is required prior to occupation. This is held against damage beyond fair wear and tear and returned within 14 days of the tenancy end date, subject to property inspection.
- Subletting the property or any part of it is not permitted without our prior written consent.
6. Included Services
Each property includes a defined set of services as described on the Solutions page and confirmed in the Rental Agreement. These may include utilities, Wi-Fi, housekeeping, and on-site staff. Services are provided as described and are not interchangeable between properties.
Additional services not listed in the Rental Agreement (such as private catering, airport transfers, or event staffing) are available on request and subject to separate charges agreed in advance.
7. Guest Responsibilities
As a Guest, you agree to:
- Treat the property and its contents with reasonable care.
- Report any maintenance issues or damage promptly to the Hijau Residences contact.
- Not make alterations to the property, its fixtures, or fittings without prior written consent.
- Comply with any house rules specified in the Rental Agreement or property guide.
- Not use the property for purposes other than residential accommodation without our written agreement.
- Vacate the property at the end of the rental period in the condition in which it was found, fair wear and tear excepted.
Guests are responsible for the conduct of all persons occupying the property during the rental period.
8. Intellectual Property
All content on our Site — including text, images, design, and branding — is the property of Hijau Residences or used under licence. You may not reproduce, distribute, or use any content from our Site without our prior written permission.
9. Limitation of Liability
To the extent permitted by Malaysian law, Hijau Residences shall not be liable for:
- Loss or damage to a Guest's personal belongings at any property.
- Indirect or consequential losses arising from a rental arrangement.
- Temporary disruption to services (e.g. utilities or internet) that are outside our direct control.
Our liability in any circumstances is limited to the total rental paid by the Guest in the preceding one-month period.
Nothing in these Terms limits our liability for death, personal injury caused by our negligence, or fraudulent misrepresentation.
10. Termination
Termination provisions — including notice periods and early termination rights — are set out in the individual Rental Agreement. In the event of a material breach of these Terms or the Rental Agreement by a Guest (including non-payment of rent), we reserve the right to terminate the agreement in accordance with Malaysian tenancy law.
11. Dispute Resolution
We prefer to resolve any dispute informally. If you have a concern, please contact us in the first instance at [email protected]. We will aim to respond within 10 business days.
Where informal resolution is not possible, disputes shall be subject to the jurisdiction of the Malaysian courts and governed by Malaysian law.
12. Disclaimers
Our Site and services are provided in good faith. We do not guarantee that the Site will be available without interruption or error. Property information is provided as accurately as possible but we do not warrant that descriptions are free from inaccuracies at all times.
We do not provide legal, financial, or immigration advice. Guests are encouraged to seek independent advice on matters relevant to their individual circumstances, including visa requirements for extended stays in Malaysia.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The current version will always be available on our Site with the "Last Updated" date shown above. Material changes will be communicated to active rental guests directly. Continued use of our Site or services following any update constitutes acceptance of the revised Terms.
